Notification
The 5th March, 2002

No. DTCP-STP (E)-2002/920:-  In exercise of the powers conferred by clause (f) of Section 2 of the Haryana Development and Regulation of Urban Areas act 1975 (Act No. 8 of 1975), and all other powers enabling him in this behalf, the Governor of Haryana hereby appoints all Sub divisional Magistrates in Haryana to exercise and perform all the powers and functions of the Director under Section 10 of the said Act in respect of the urban areas under their jurisdiction.

In exercise of the powers conferred upon me under sub section 2 of section 19 of the Punjab Scheduled Roads and Controlled areas Restriction on  Unregulated development Act 1963, I, Sanjeev Kaushal, IAS, Director, Urban Development Department, Haryana, with the prior approval of the Government  do hereby delegate the powers and functions vested in me under section 9 and 12 of the said act to all the District Town Planners of the Department of Town 7 Country Planning in respect of the controlled areas falling within Municipal Limits in their respective jurisdiction.

Subject: Issue of Certificate regarding the location of sites falling put side the Controlled areas or Urban Areas.

Reference: In Continuation of the instructions issued vide memo No. 10713-37 dated 12-7-1996.

 1.  It is clarified that as per the decision of the Govt. the Department is not to insist for obtaining the NOC's for the sites falling outside the Controlled Areas  or Urban Areas.

2.   However the concerned District Town Planner may issue a certificate to the effect that the site applied for (detail of  Khasra No.s and area should be mentioned) falls outside the Controlled Area or Urban Areas  and does not about the scheduled road. If it is a  condition imposed by the Financial Institutions or any other Govt. Deptts/ Agencies.

3.   In case site falls outside the Controlled Area but about the Scheduled road, the applicant may be advised to obtain permission under section 3 of the Act No. 41 of 1963 from concerned Executive Engineer of the P.W.D (B&R), Haryana.
